The team Homefile
Home Information Packs become mandatory from June 1st 2007
– our pack will be called a ‘Homefile’ and is already available to our clients – free of legal fees.
The Government is forcing vendors to make legal documentation for their property available as soon as marketing commences - although we are hopeful that this will be amended so that properties can be marketed while the pack is being prepared.
Prospective purchasers will therefore be better informed when making an offer with any problems coming to light earlier – the result being quicker sales and less abortive transactions.
The pack must contain:
- An index (i.e. a list of the contents of the Pack)
- A sale statement (summarising terms of sale)
- Evidence of title
- Standard searches (i.e. local authority enquiries and a drainage and water search)
- An Energy Performance Certificate
- Where appropriate, commonhold information (including a copy of the commonhold community statement)
- Where appropriate, leasehold information (including a copy of the lease, information on service charges and insurance)
- Where appropriate, a New Homes Warranty
- Where appropriate, a report on a home that is not physically complete
Additional authorised documents that may be included:
- A home Condition Report (HCR)
- Guarantees and warranties
- Other searches.
The team Homefile contains all the required documentation listed above except the Energy Performance Certificate – who, what and how this is to be affected is still under discussion with Government.
Our clients only have to pay the solicitors disbursements; we undertake to pay the legal fees for the preparation of the Pack – and not for solving any legal problems that may come to light of course.
If a vendor requires a Home Condition Report, which remains voluntary for the time being, we can have this carried out quickly – this could save of client’s further delay and stress, and may be a great way to attract first time buyers.
